ملخص:
اتخذت النيابة
العامة موقعا استراتيجيا مهما في نظام العدالة الجنائية الحديث ، حيث كانت وظيفتها
تقتصر على الملاحقة بطريقة آلية، إلا أنها أصبحت اليوم تمارس صلاحيات قضائية كثيرة
ضمن مختلف مراحل الدعوى العمومية، وهذا بعدما قام المشرع بتوسعة صلاحياتها سواءا
في مرحلة البحث والتحري أو قيامها بإنهاء الدعوى العمومية دون محاكمة إما عن طريق
التصرف بالحفظ أو عن طريق اجراء الوساطة الجزائية، أو مباشرة الدعوى العمومية الى
غاية إحالتها للقضاء وصدور حكم نهائي بشأنها.
résumé: Le Bureau du Procureur a pris une position stratégique
importante dans le système moderne de justice pénale, où sa fonction se limite
à poursuivre de manière automatique, mais aujourd’hui il a exercé de nombreux
pouvoirs judiciaires dans les différentes étapes de la procédure publique,
après que le législateur a élargi ses pouvoirs, que ce soit dans la phase de
recherche L’enquête ou la cessation de la procédure publique sans procès, soit
par le biais de l’acte de préservation, soit par la conduite d’une médiation
criminelle ou par la poursuite de poursuites publiques jusqu’à son renvoi au pouvoir
judiciaire et son jugement définitif sur ce sujet Summary: The Office of the
Public Prosecutor has taken an important strategic position in the modern
criminal justice system, where its function is limited to prosecuting in an
