ملخص:
نظم الدستور
الجزائري الحالات المؤدية لشغور منصب رئيس الجمهورية في المادة 102 منه وحصرها في
العجز النهائي، الوفاة، الاستقالة وكذلك نظم الإجراءات التي يتم بها التثبت من
وجود المانع بحيث أوجب على المجلس الدستوري الاجتماع ليتثبت من حقيقة وجود مانع
للرئيس يؤدي إلى عجزه عن أداء مهامه وذلك بكل الوسائل الملائمة وبعد التثبت يقترح
المجلس الدستوري بالإجماع على البرلمان التصريح بثبوت المانع ليعلن هذا الأخير
المنعقد بغرفتيه وبأغلبية ثلثي (2/3) أعضائه ثبوت المانع لرئيس الجمهورية ويكلف رئيس
مجلس الأمة برئاسة الدولة بالنيابة لمدة أقصاها 45 يوما يمارس فيها كل الصلاحيات
المخولة لرئيس الجمهورية ما عدا ما استثنته المادة 104 وبعد انقضاء المدة المحددة
ودوام واستمرار المانع يتم إعلان الشغور بالاستقالة وجوبا وفق الإجراءات المذكورة
سابقا في حالة المانع المؤقت بسبب المرض الخطير أو المزمن أما في حالة الاستقالة
أو الوفاة فيجتمع المجلس وجوبا ويثبت الشغور النهائي لمنصب رئيس الجمهورية ليتم
التبليغ الفوري للبرلمان المجتمع وجوبا بشهادة التصريح بالشغور النهائي وهذا ما
يجعل رئيس مجلس الأمة رئيسا للدولة بالنيابة لمدة تسعون يوما تنظم خلالها
الانتخابات طبقا لأحكام الدستور ولقواعد القانون المنظم للانتخابات وأضافت المادة
أنه لا يحق للرئيس المعين بهذه الطريقة الترشح لرئاسة الجمهورية وذلك ضمانا
لشفافية الإجراءات، ونظمت المادة في فقرتها الأخيرة حالة شغور منصب رئيس مجلس
الأمة سواء باستقالته أو وفاته أو لأي سبب كان، فيجتمع المجلس الدستوري وجوبا
ويثبت بالإجماع اقتران الشغور النهائي لرئيس الجمهورية وحصول مانع لرئيس مجلس
الأمة ليتولى في هذه الحالة رئيس المجلس الدستوري مهمة رئاسة الدولة وينطبق عليه
ما تم تنظيمه لرئيس مجلس الأمة أثناء نيابته لرئيس الجمهورية.

Abstract The Algerian constitution regulates cases leading to the
vacancy of the post of President of the Republic in the article 102, and
restricting them to the final disability, death and resignation. It regulates
also the procedures for checking the existence of the impediment, so that the
Constitutional Council has to meet to ascertain the fact that there is an
impediment to the president that leads to his inability to perform his duties
by all appropriate means and after confirmation, the Constitutional Council
unanimously proposes to the Parliament to authorize the establishment of the
impediment. This latter, held in his two chambers and by a two-thirds majority
(2/3) of its members, will announcethe impediment proved to the President of
the Republic. The President of the Council of the Nation shall be charged with
the head of the State for a maximum period of 45 days in which all the powers
conferred upon the President of the Republic shall be exercised except as
excluded by Article 104. After the expiration of the specified period and the
duration of the impediment, temporary vacancy is declared due to serious or
chronic illness. In case of resignation or death, the Council shall meet and
decide upon the final vacancy for the post of President of the Republic. This
makes the president of the Council of the Nation an Acting President for ninety
days, during which the elections shall be organized in accordance with the
provisions of the Constitution and the rules of law governing the elections.
This article added that the President appointed in this way will not run for
president to ensure the transparency of the procedures. In its last paragraph,
the article regulates the vacancy of the post of president of the Council of
the Nationeither by resignation or death or for any reason. The Constitutional
Council shall meet and decide unanimously the final vacancy of the President of
the Republic and the impediment of the President of the Council of Nation. In
this case, the President of the Constitutional Council shall assume the
functions of the Head of State and shall apply to him what has been applied to
the President of the Council of Nation during his tenure as President of the
Republic.
