ملخص:
يتلخص موضوع
البحث في أن مبادئ القانون الجنائي وفقا لما عالجه نظام روما الأساسي ، جاءت نتيجة
لسنوات طويلة من الإجتهاد الفقهي القانوني إضافة إلى التجارب المستخلصة من المحاكم
الجنائية الدولية المؤقتة، ليوغسلافيا وروندا حيث يعد نظام روما الأساسي نتيجة بحث
ودراسة مضنية ،للجنة القانون الدولي التي قامت بإعداده بهدف إيجاد قضاء دولي جنائي
دائم، يتجاوز الأخطاء التي شابت الأنظمة السابقة وقد جاء نظامها واضحا في تحديد
اختصاصها بجرائم ،الإبادة الجماعية والجرائم ضد الإنسانية وجرائم الحرب وجرائم
العدوان كما أنها أوردت مبادئ القانون الجنائي بشكل مفصل في الباب الثالث من
المادة ٢٢ إلى ٣٣ والتي عالجت مبدأ الشرعية الجنائية، والمسؤولية الفردية للشخص
إضافة إلى عدم رجعية نصوصه ،حيث لا يسري على جرائم حدثت قبل دخوله حيز النفاذ
بالإضافة إلى عدم أخذه بمبدأ التقادم باعتبار أن طبيعة الجرائم التي تختص بها
المحكمة خطيرة وتمس بالسلم والأمن الدوليين ،كما أن النظام الأساسي قد فصل في
موانع المسؤولية الجنائية ،ولخصها في السكر غير الإختياري إضافة إلى المرض العقلي
وحالة الإكراه وكذلك الدفاع الشرعي وصغر السن ،كما أن نظام المحكمة لا يأخذ
بالحصانة الممنوحة للأفراد بحكم وضائفهم ولاحتى بأوامر الرئيس الأعلى كمانع
للمسؤولية الجنائية ،ويحدد الشروط التي يجب توافرها لإعتبار أي منها سببا من أسباب
الإباحة ،فقد بين كل هذه الحالات بشكل مفصل، كما أورد النظام الأساسي العقوبات
الواجب تطبيقها، حيث تتراوح من السجن لعدد من السنوات إلى ٣٠ سنة إضافة إلى السجن
المؤبد، مع ترك مجال الحرية للقاضي بتقديرها وفقا لما يراه مناسبا ونشير كذلك إلى
أن المحكمة الجنائية الدولية، لم تأخذ بالمسؤولية الجنائية للدولة والأشخاص
الإعتبارية حيث تختص بالأشخاص الطبيعية دون غيرها ،غير أنها تأخذ بالمسؤولية
المدنية للدولة في تعويض ضحايا الإنتهاكات والجرائم المرتكبة باسمها ولحسابها
،ونشير في الأخير أن المحكمة الجنائية الدولية، تشكل مكسبا هاما للمجتمع الدولي
والإنسانية ،على السواء مع ما يشوبها من نقائص لكنها تبقى الجهاز الدولي الوحيد
القادر، على متابعة مرتكبي الجرائم والإنتهاكات الدولية ومحاسبتهم .
The subject of the research is that the
principles of criminal law ,as dealt with in the Rome Statute are the result of
many years of jurisprudence, as well as the experiences of the International
Criminal Tribunals, for Yugoslavia and Rwanda where the Rome Statute, is the
result of exhaustive research and study by the International Law Commission,
With a view to creating a permanent international criminal justice system, that
goes beyond the mistakes of the previous regimes Its system is clear in
determining, its jurisdiction over crimes, genocide crimes against humanity war
crimes and crimes of aggression, Article 22 to 33 dealt with the principle of
criminal legality and the individual responsibility, of the person as well as
the Not retroactive of its provisions, as it does not allow for crimes that
occurred prior to its entry into force and that it does not take into account,
the principle of statute of limitations as the crimes of the Court , are serious
and detrimental to international peace and security, In addition the statute
has been separated from criminal liability, summarized in non-voluntary sugar
as well as mental illness, and coercion as well as legitimate defense and young
age, The court system does not take immunity granted to individuals by virtue
of their subordinates and the orders of the superior as a liability ,All of
these cases, are described in detail The Statute also stipulates the penalties
applicable, ranging from imprisonment for a number of years to 30 years in
addition to life imprisonment, The International Criminal Court has not taken
the criminal responsibility of the State and juridical persons, since it is
exclusively concerned with natural persons, but it takes the civil responsibility
of the State to compensate, victims of the violations and crimes committed in
its name and to account for them The International Criminal Court, is an
important asset for both the international community and humanity, with its
imperfections, but it remains the only international body capable, of following
up and holding accountable the perpetrators of international crimes and
violations.
